Terms of Service
Effective June 29, 2026
These Terms of Service ("Terms") are a binding agreement between you and ClayPass ("ClayPass," "we," "us," or "our") governing your access to and use of the ClayPass website, applications, and membership network (together, the "Service"). By creating an account, starting a membership or free trial, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Please also read our Privacy Policy, which is incorporated into these Terms.
1. What ClayPass is — and is not
ClayPass is an independent membership and discovery network for clay-target and firearms shooting sports. A ClayPass membership unlocks member rates, member perks, discovery, and community features at independent partner clubs and ranges ("Clubs").
ClayPass is a marketing, listing, and booking-coordination platform only. ClayPass does not own, operate, manage, or control any Club, range, or shooting facility; does not host, organize, staff, officiate, or run any event; does not employ, supervise, certify, or train any range officer, instructor, or staff; does not sell, transfer, rent, ship, or store firearms or ammunition; and does not grant membership in, or admission to, any Club. Each Club is an independent business solely responsible for its own facility, staff, safety, rules, pricing, admission decisions, and events.
Members pay Clubs directly. ClayPass charges you only for your ClayPass membership. All shooting sessions, day passes, guest fees, targets, rentals, lessons, and event entry are paid by you to the Club, at the Club. ClayPass takes no commission on, and is not a party to, any transaction between you and a Club.
2. Eligibility & age
You must be at least 18 years old to create a ClayPass account, and you represent that you are. Certain activities, disciplines, or facilities (for example, those involving handguns) require participants to be 21 or older or to meet other age requirements under federal, state, or local law or under a Club's own rules. You are responsible for meeting all applicable age requirements for any activity you choose to pursue. Where minors participate at a Club or event, they do so under the Club's rules and the supervision and responsibility of a parent or legal guardian.
3. Membership, free trial, billing & cancellation
ClayPass offers tiered memberships (such as Basic, Plus, and Pro). Membership begins with a free trial (currently 10 days). You provide a valid payment method when you register; you are not charged during the free trial. Unless you cancel before the trial ends, your membership will automatically convert to a paid, recurring monthly subscription and we will charge your payment method at the then-current price when the trial ends, and each month thereafter until cancelled. We disclose the price, the trial length, and the date of your first charge before you subscribe.
- Cancel anytime. You may cancel in one click from your membership settings. Cancellation stops future renewals; your access continues through the end of the current paid period.
- Refunds. Membership fees are non-refundable once a renewal charge has been made, except where required by law. You may cancel a free trial at any time before the first charge to avoid being billed.
- Price changes. We may change membership prices or plan features; we will give you notice and the change will apply to your next renewal.
- Benefit depth. Plans differ in benefit depth (such as the number of Home/Preferred Clubs and community features), not in any guarantee of access to any particular Club.
Membership unlocks benefits and rates offered by Clubs. It is not equity, a proprietary or voting membership in any Club, or a guarantee of availability at any Club.
4. Your account & conduct
You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. You agree not to misuse the Service, including by attempting to farm trials or memberships, scraping data, interfering with the Service, impersonating others, or using the Service for any unlawful purpose. One membership is for one person; verified phone numbers are limited to one active account.
5. Club autonomy
Each Club is independent and sets its own terms. This includes, without limitation, its safety rules, range commands, eligibility and admission decisions, guest and visitor policies, operating hours and seasons, pricing, perks, equipment and ammunition policies, dress and conduct codes, and event rules. A Club may, at its sole discretion, require you to sign its own waiver, complete its own registration, or hold or purchase its own membership or day pass before you may shoot. ClayPass does not control these requirements and is not responsible for a Club's decisions, rules, or operations. A reservation through ClayPass is a request to attend; the Club admits you under its own rules, and admission and service are at the Club's discretion.
6. Reservations & cancellations
Reservations made through ClayPass help a Club anticipate your visit; they are not a guarantee of service, capacity, weather, or a specific lane, station, time, or instructor. You agree to honor your reservations, arrive on time, and follow the Club's check-in process. Cancellation, no-show, and rescheduling rules are set by ClayPass and/or the Club and are shown at the time of booking; please review them before you reserve. Because you pay the Club directly at the time of your visit, ClayPass does not process refunds for sessions.
7. Range closures & availability
Clubs and ranges may close, restrict, delay, or cancel access at any time and without notice — including due to weather, lightning, poor visibility, darkness, competitions or private events, maintenance, construction, capacity limits, regulatory or law-enforcement action, or safety concerns. Hours and availability shown in the Service are provided by Clubs and may be inaccurate or change. ClayPass is not responsible for any closure, restriction, delay, cancellation, or unavailability, and these do not entitle you to a refund of your membership.
8. Safety & assumption of risk
Shooting sports are inherently dangerous activities that involve firearms, projectiles, noise, recoil, moving targets, terrain, weather, and other risks of serious bodily injury, permanent disability, or death. By using the Service to discover, reserve, or attend any Club or event, you acknowledge and voluntarily accept all such risks. You are responsible for your own safety and for the safe handling of any firearm; for using appropriate eye and ear protection; for knowing and following all range rules and the commands of range staff; and for confirming that any activity is appropriate for your skill and physical condition. You agree to follow all Club and event safety rules at all times.
9. Waivers & releases
Where you reserve a session or register for an event through the Service, you may be required to accept a liability waiver and assumption-of-risk acknowledgment, which is recorded with a timestamp. This does not replace any waiver a Club requires — Clubs commonly require you to sign their own waiver and complete their own registration on site, and you agree to do so where required. To the fullest extent permitted by applicable law, you release ClayPass and its officers, employees, and agents from claims arising out of your participation in shooting activities or events, your use of any Club or range, or the acts or omissions of any Club, instructor, staff member, or other participant. Some jurisdictions limit the enforceability of waivers; nothing here waives any right that cannot be waived by law, and waivers do not apply to gross negligence or willful misconduct where prohibited.
10. Firearm law compliance
You are solely responsible for complying with all federal, state, and local laws, regulations, and ordinances applicable to your possession, transport, storage, rental, and use of firearms and ammunition, and to your participation in shooting activities. This includes, without limitation, eligibility to possess firearms, licensing and permit requirements, transport and storage rules, magazine and ammunition restrictions, and any required background checks or registrations. Laws vary significantly by jurisdiction. ClayPass does not sell, transfer, or provide firearms or ammunition, does not conduct background checks, and does not verify your eligibility; nothing in the Service is legal advice. You agree not to use the Service or any Club in violation of any applicable law.
11. Geographic & state-law differences
The Service is offered across many jurisdictions, and the laws governing shooting facilities, firearms, memberships, consumer subscriptions, and waivers differ materially from state to state and locality to locality. Features, perks, age limits, available activities, and your legal rights may differ depending on where you and the Club are located. You are responsible for understanding and complying with the laws that apply to you and to any Club you visit.
12. Events
Events, classes, leagues, clinics, lessons, and competitions listed in the Service are hosted, organized, operated, staffed, and run solely by the Club identified as the host ("Hosted & operated by [Club]"). The host Club determines eligibility and rules, conducts registration, collects all fees directly, provides all range officers and safety personnel, administers scoring, and awards any prizes. ClayPass's role is limited to listing and promoting events for member discovery and, where the Club provides one, linking to the Club's own registration. You participate at your own risk and under the host Club's rules and waivers.
ClayPass-run promotions & prize draws. Where ClayPass itself runs a promotion (for example receipt-upload prize draws or referral rewards), no purchase beyond your membership is necessary, winners may be selected at random or per the stated promotion rules, and prizes are non-transferable. Prizes and rewards are taxable income to you: if the value we pay or award you reaches IRS reporting thresholds (generally $600 in a calendar year), we will request a Form W-9 before delivering payment and issue a Form 1099. Void where prohibited.
13. Partner Clubs joining or leaving the network
The roster of partner Clubs changes over time. Clubs may join, change their offerings, suspend participation, or leave the network at any time, and ClayPass may add, remove, suspend, or decline any Club at its discretion. ClayPass does not guarantee that any particular Club, location, rate, perk, event, or feature will be available now or in the future, and the addition or removal of any Club does not entitle you to a refund of your membership. If a Club you have designated as a Home or Preferred Club leaves the network, you may select another.
14. Suspension & termination
We may suspend or terminate your account or membership, with or without notice, if you violate these Terms; if you engage in unsafe conduct, harassment, fraud, or misuse of the Service or a Club; if a Club reports a safety violation or misconduct; or as needed to protect the Service, Clubs, or other members. Clubs may independently refuse admission or remove you for any lawful reason under their own rules. You may stop using the Service and cancel your membership at any time. Sections that by their nature should survive termination (including disclaimers, releases, limitations of liability, and indemnification) will survive.
15. Insurance disclaimer
ClayPass does not provide, and a ClayPass membership does not include or constitute, any insurance, indemnity, medical coverage, accident coverage, or warranty of any kind for you, your property, or your participation in any activity. Any insurance carried by a Club is the Club's own and does not run to your benefit unless the Club agrees otherwise in writing. You are responsible for obtaining any insurance you wish to have.
16. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service, Club information, hours, availability, pricing, or perks are accurate, complete, current, or uninterrupted. Information about Clubs and events is provided by Clubs and third parties, and ClayPass is not responsible for it.
17. Limitation of liability
To the fullest extent permitted by law, ClayPass and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for any personal injury, death, or property damage, arising out of or relating to your use of the Service, any Club or range, any event, or the acts or omissions of any Club or third party — even if advised of the possibility of such damages. To the maximum extent permitted by law, ClayPass's total aggregate liability for any claim relating to the Service will not exceed the amount of membership fees you paid to ClayPass in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
18. Indemnification
You agree to indemnify and hold harmless ClayPass and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your participation in any activity or event, your violation of these Terms, or your violation of any law or the rights of any third party (including any Club).
19. User content & intellectual property
The Service, including its design, text, and software, is owned by ClayPass and protected by law; the "ClayPass" name and logo are our marks. If you submit reviews or other content, you grant ClayPass a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Service. You are responsible for content you submit and must not submit anything unlawful, infringing, or that you do not have the right to share.
20. AI assistants
The Service may offer automated AI chat assistants. These are automated and may be inaccurate; they do not provide legal, safety, medical, or other professional advice, and any club suggestions they make are informational and not endorsements. Do not rely on them for safety- or law-related decisions. Messages you send to an assistant may be processed by a third-party AI provider as described in our Privacy Policy.
21. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice (for example, in the app or by email) and update the effective date above. Your continued use of the Service after a change takes effect means you accept the updated Terms.
22. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules, except where the consumer-protection law of your state of residence provides otherwise. Any dispute arising out of these Terms or the Service that is not resolved informally will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction, except where applicable law gives you the right to proceed in your local courts (including small-claims court). Before filing any claim, you agree to first contact us at support@claypass.com and give us 30 days to work it out. We may adopt an arbitration provision and class-action waiver in a future update to these Terms, with notice, where enforceable.
